These terms apply to all orders placed with EarEqual through earequal.com. Please read them before ordering. By placing an order you agree to them.
Your contract is with Marko Hiipakka, a sole trader (Empresário em Nome Individual) registered in Portugal under tax number (NIF) 278096190, at Solmar Business Centre, Avenida Infante D. Henrique 71, 9504-529 Ponta Delgada, Azores, Portugal. You can reach us at hello@earequal.com.
EarEqual products are acoustic measurement accessories, hand-built in small batches. Each item is made to a consistent design; minor variations in finish are normal for a hand-built product and are not defects.
Some items are offered as pre-orders. When you pre-order, you are reserving an item from an upcoming build. Any delivery date we give is a good-faith estimate, not a guaranteed date. We will keep you informed by email and dispatch as soon as your item is ready. If we expect a significant delay, we will tell you and you may cancel for a full refund.
Prices are shown in euros (EUR) and include VAT at the applicable Azores rate (16%). Payment is taken securely at the time of order through Stripe. We do not see or store your card details. A VAT invoice (fatura-recibo) is issued for every order.
We ship worldwide from Portugal (the Azores), with the exception of the United States, which we expect to open shortly. Shipping is charged at a flat rate, shown separately at checkout. Delivery times vary by destination and are estimates only.
For shipments outside the European Union, import VAT, duties or handling charges may be applied by the destination country on delivery; these are the responsibility of the buyer and are not included in the price or shipping cost.
If you are a consumer in the EU, you have the right to withdraw from your purchase within 14 days of receiving the goods, without giving a reason. For pre-orders, this period runs from the day you receive the item, so you may also cancel at any point before it ships.
To withdraw, email us at hello@earequal.com before the period ends. You then return the item to us within 14 days. We will refund the price (and standard outbound shipping) within 14 days of receiving the returned item or proof that you have sent it. You are responsible for the cost of returning the item, and for any loss in value caused by handling beyond what is needed to check it.
Because EarEqual products are in-ear devices, they are supplied sealed for hygiene reasons. If the seal has been broken, the item can no longer be returned under this right. A sealed, unopened item can be returned as described above. This does not affect your rights if an item is faulty (see Guarantee of conformity below).
Your purchase comes with the legal guarantee of conformity provided under EU and Portuguese law. If an item is faulty or not as described, you are entitled to have it repaired, replaced, or refunded. Contact us and we will put it right.
Nothing in these terms limits your statutory rights as a consumer or our liability for anything that cannot be limited by law. Beyond that, our liability for any claim relating to a product is limited to the price you paid for it.
These terms are governed by the law of Portugal, and any dispute is subject to the competent Portuguese courts. As a consumer, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
We may update these terms. The version in force is the one published here when you place your order.
